Applying for a utility model in Finland   


A utility model is a form of protection for the invention that is between patent and design rights. The requirements concerning the innovative characteristics of an object or utility model are not as strict as for a patentable invention.

Utility model rights may be granted for a technical solution concerning form or structure, or their combination, that is commercially exploitable, as well as for chemical compounds, food and medicinal products and biological discoveries. Method inventions are not covered by the utility model right

Like a patent, the invention subject to a utility model must be new. However, unlike a patent application, a novelty search will not be conducted at the time of application for a utility model. The matter will only be declared invalid on the basis of the documents delivered in connection with the claim for invalidity declaration. For this reason, anyone wishing to exploit an invention should actively follow newly registered utility models.

Applying for a utility model in Finland

Novelty search

The applicant may request the registration authority to conduct an examination on the utility model to estimate whether the invention described in the product is new in comparison with earlier ones. The examination is subject to a fee.

Basic information on valid utility model registrations and models deleted from the register is available through the HyManetti service on the NBPR website.

Period of validity

The utility model is valid for 4 years from the date of application. The period may be extended by 6 years (4+2) by paying the renewal fees.

Application process

In Finland, utility model applications are submitted to the National Board of Patents and Registration. Those domiciled in Finland may submit an application in Finnish or Swedish. Claims for protection must be made in both languages. Although it is possible to make an application in other languages, and obtain an application date, the application will not be processed until it has been translated into Finnish or Swedish.

Utility model applications may be sent by post to The National Board of Patents and Registration, PL 1160, 00101 Helsinki, or delivered to the PatRek Customer Service, Arkadiankatu 6 A, 00100 Helsinki. Each application must refer to one invention only.

The registration fee for a utility model is 135 Euro (2004). The first renewal of registration for 4 years costs 200 Euro and a further renewal for 2 years 135 Euro.
